Can I claim on medical grounds?

Hello all.
In January 2008 my 16 year marriage broke down and in March 2008 I took out a personal loan with Black Horse. It was to pay off the final year of a finance agreement with Black Horse (for "our" motorhome that I was keeping as part of the pending divorce settlement) that was in my name but my then wife was named as guarantor (sp?). I had to do this because obviously she didn't want to be involved if I defaulted on the loan, which is fair enough. The loan was for approx. £7K and the PPI was approx £3K.
At the time I was in a hell of a state emotionally, what with us seperating and all, and to be honest I spent most of the time at Black Horse struggling not to break into tears. I don't remember much of what was said, just a great sense of relief when they agreed the new loan. TBH, my main memory is driving home in tears
big rough middle-aged Yorkshireman that I am :rolleyes: A couple of weeks later my doctor diagnosed me as suffering from depression and exhaustion, and prescribed me anti-depressants and sleeping tablets.
Question- is it worth me trying to claim back the PPI due to my poor state of mind at the time? If not, no worries as life has got better since then but if anyone thinks I can, I'll give it a go. And FWIW, the new loan was over three years but I paid it off in July of this year

In a word, no. It would be very difficult to argue a lack of mental capacity due to depression and exhaustion, your condition would need to be much more serious.Gone ... or have I?0

Putting the depression aside for a minute even though you had depression and signed for the PPI was it explained to you that the PPI would be another loan on top of your original loan and incurred interest on it. If it was not then that is another reason for a possible missale. Even without depression lots have been ripped off by this. Did they ask you if you were covered elsewhere and about any previous medical conditions not been covered or even give you an option at all of the PPI. Sometimes you are not even given the choice and its automatically included. Also they should have offered it to you and given you a choice of buying elsewhere or not at all as its not compulsory.
If I were you I would take a look through this link here and see if other things apply to you as there are lots of misselling reasons

Hi Martyn,
I was just successful claiming PPI refund from Black Horse, it only took a few weeks for cheque to come through.
I think you may have difficulty going down the medical grounds route. I hope I’m not giving you bad advise here (I’m just a wee rookie) I suggest that you keep it simple and claim due to being advised that you must take the insurance to get the loan. (you probably were told this at the time but don’t remember)
