Hope someone here can help.
I rented office space with these bunch of cowboys startanywhere.com
from January 2009 until September 2009 and paid a service retainer of £500 at the beginning.
After many many chases they haven't bothered replying so I had no alternative but to take them to court. the cheeky blighters have now put in a defence and said that they never a contractual relationship with me!! He's trying it on as the contract is under my company name but the court claim in my personal name.
They took money from my personal bank account every month and I even have the transaction details of the deposit paid on 23/12/08 so I got proof.
Should I go ahead with the court order with the claimant name as mine or change it and pay another fee with the company name?
It seems pretty obvious that I paid the money to him, but can he getaway with it due to a technicality?

The legal entity that had the tenancy and paid the deposit is the entity that any legal action should be launched on behalf of. Only you can answer whether you and your company can be considered the same or seperate legal entities, which will depend on the company status.0

Yup, if the contact was with DangerousDogs Ltd(the company) rather than pitbulluk(The man) then DangerousDogs Ltd must take action...0 -
I believe that if you are a sole trader, rather than a limited company, you use the following for which ever applies to the claimant or defendent
FirstName LastName T/A SoleTraderName
T/A = trading as
example
