wtc/ ctc argument

i have had nothing but arguments with TAX CREDITS.
O/H started self employment oct 2006, informed tax credits of this was fine. Didnt get much incopme first 7mths tho from the work.
In April 2007 i got renewal pack in phoned up asked about self employment ie what was included for tax purposes as we'd found diff places included different things. Was told it is "whatever your husband takes from the business", so i counted up what hed taken out business account (which was mostly from what he'd put into it the previous year when started up, as hadnt had much business!)
in 2008 i did same again. His income for year 07/08 was around £6800, but in may this year 2009, while talking to lawyer over completely unrelated topic, he told us that we didnt even have the minimum income for family five, basing it on hubbys profit and the wtc/ctc.
I now know that the tax credits should have been based on just PROFIT for that year and NOT "whatever hubby takes from business" profit for 07/08 was £2500, so a diff of £4000 from "income"
i wrote letter complaining bout this and they are argueing that i WASNT told that info, or at least they cant find any recording of the conversation, so will not alter the info and therefore we have lost good bit money.
Also 2008/09 they mucked up our claim when id phoned making enquiry about disability premium as id been put onto incapacity. following week i noticed large payment int account queried it was told was "final payment" as claim been stopped!! why no one knows except human error, but despite me questioning it they not only reinstated it but paid MORE money into account on two occassions. I phoned and questioned them was told " its the time of year that sort all claims it is what you are entitled to stop worrying your payments will return to normal now until april 09" (this was end feb/start march. got renewal pack in phoned up gave income levels (again not profit) for 08/09 year so they could work out 09/10 payments. Then got letter few days later to say we had been overpaid for the year and weretn getting money for next 4weeks. I told them i couldnt do without it, so they paid us but took it all back off this years payments.
I argued that shouldnt have to pay it back, yes income was slightly higher than had indicated but our yearly payments would have been almost exaclty right if they hadnt mucked up and paid all the extra into our account and told us we were entitled to it. I dont see why i should pay back money that someone else made mistake about. i did appeal but again they are refusing to budge, so they have claimed load dosh back this year but are refusing pay us extra we should have got previous year!
can anyone advise, they told me all i can do is request all calls ive made to be looked at but they might not do it!

Tax credit applications come with a book that's thicker than the application itself and gives instructions on how to calculate yearly income so i don't see how the person from the advice line is to blame anyway as it's all there on paper with the application form.0

I think the best thing to do to take this forward (as I assume you want to) is to make a "subject access request" for the calls you made. Basically this is a request for the transcript of the calls you have made to the helpline. If you were misadvised then you will have the proof. I am not sure of the address/fax no. You can request the number/address from the tax credit helpline.0
