Ancilliary releif - absent partner

Does anyone know if a financial settlement (ancilliary relief) can be made in the absence of one partner, say if they refuse to provide relevant proof of income or dont turn up in court?
Am i stuck forever in a house that only half belongs to me? Will his name always be on the mortgage so i cant change it to get a better deal?
