thats not how it was explained to me by the cab many moons ago .
i went into my bank all guns blazing told them what the cab had told me and i got my money back but things may have changed

From what I can fathom the First Right of Appropriation is part of common law. That is it is a law that has come about through cases presented before judges throughout the ages. It has not been been specifically legislated for in the Houses of Parliament. These laws may or may not be applicable in certain circumstances and the only way to decide in the event of a dispute is to let a court decide. If you can't afford to take it to court then you will lose.

Same thing happend to someone I know. I recomed getting another bank current account asap and getting a decent free incentive to join that bank. A&L offered £50 i recall via a friend invite recently - this sort of extra cash might help in the next week or so. Also consider your overdraft position. This is a great time to review everything and start getting help with debt. Some debitors you need to write to asap to explain the situation, and get debt advice before you do this.

They did the same thing to me in similar circumstances. It was resolved by talking to collections and setting up a standing order to pay off the balance. Yes the banks do have a right to do that but they dont have a right to put you in hardship. They are p***ing in the wind legally everytime they do that.
