Euro Car Parks Parking Charge Notice

Hi there

I have 'NEVER' received a parking or speeding ticket in the many years of me driving until now. I was visiting my local supermarket and I had my baby with me along with my disabled sister-in-law and I originally tried parking in a 'baby' space (as I cannot open my doors wide enough to get her out in a normal space) but these were taken up by cars without child seats ('surprise surprise' I hear you say!). I then parked in a disabled space and my sister-in-law put her badge on the dashboard whilst I saw to my baby. Upon our return, I had been issued with the PCN which requires payment of £50 within 14 days or £70 if paid within 21 days. I was extremely angry because I knew we had a valid reason for parking there and had used a disability badge but quickly realised the badge had either been knocked onto the floor by my sister-in-law (as she struggles getting in and out of cars due to her MS) or had fallen onto the floor when she slammed the door. She obviously feels very guilty but it isn't her fault. Upon looking into appealing against this ticket, I have read many posts saying that PCN's are unenforceable. Can someone please confirm whether this is the case with this type of ticket. I have to add that the signs are clear with regards to parking there. I do not want to ignore this PCN if this is one which I should be legitimately appealing against and I'm also unsure whether my appeal would be successful as I really cannot afford to pay the full £70 so would want their response to my appeal within the next 10 days. Any help/advice would be greatly appreciated. :eek:

    It's a scam unenforceable invoice.

    Euro Car Parks are easy to ignore. Expect letters from them, Brinx and Credit Control and then they give up. No chance of court whatsoever.

    There is no appeal process - it's a mail scam being run by a parasitic company. Ignore, relax and get on with your life.

    Both disabled and mother and baby spaces have no basis in law in private car-parks. The markings on the ground are just graffiti. They may as well have put up signs saying "reserved for people called Kevin" or "reserved for redheads". That's how unenforceable they are.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Euro Car Parks are the stupid idiots who got me interested in this whole scam in the first place this year. Silly, silly people, putting one of their scam tickets on a car owned by one of my family. Big mistake! :D

    I absolutely deplore this scam and the fact that nothing is done about it.
    I now come on this forum every day to tell people like you to ignore PPC scam tickets.

    BTW, in our case the timeline with Euro Car Parks has been:

    1. The fake PCN (I laughed when my relative showed me the piece of rubbish, as I already knew about the scam!)

    2. A letter from Euro Car Parks when the registered keeper didn't pay or contact them.

    3. A couple of letters from CCS Collect (nothing from Brinx) about six weeks apart. Some old rubbish about they 'may' proceed with litigation which 'could' result in a CCJ. Tell us another! :rotfl:

    That was earlier this year, not sure if we have reached the 'Final Warning We Really Mean it' stage yet! Either way we don't care, they don't do Court and even if they did I know my relative could get a solid defence from pepipoo.

    Oh and BTW you still have an unblemished driving record. You have still never received a fine.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Welcome! *PLEASE READ BEFORE POSTING*
    Please start a new thread for your case (if you post in the discussion threads your post will not be seen by many) and take a look at these two threads which will be of assistance:

    1) SCAN the PCN (front and back) together with any other paperwork (200dpi should be fine). Pictures of the parking bay/signs/lines will also help.

    2) BLANK out personal details (i.e. PCN serial number, car registration number, any name/address details) using Paint or equivalent image editing program to remove appropriate details.

    3) UPLOAD to image hosting site and link from your thread - simply copy and paste the "direct link for layout" link which looks something like this: http://tinypic.com/xxxxxxxxx.jpg.

    4) MENTION which council issued the PCN/NtO if you're unable to scan paperwork.


    Private Parking Companies (PPCs)
    (Read Martin's Article)

    1) PPC tickets (referred to by some as toilet paper :p) are NOT fines or fixed penalties, they are invoices based on a presumed contract with the driver.

    2) When posting, please don't mention your vehicle make/model or exact location and most importantly do NOT say who was driving. PPC trolls do read these and other forums and may try to use this information against you. Do not post any info that may identify you. It isn't usually necessary to post the 'ticket' from a PPC.

    3) PPC charges have been shown to be generally unenforceable in Court, and they hardly ever issue proceedings, despite the threats in their intimidatory letters.

    4) Do NOT write to the PPC to 'appeal' the ticket - the appeals process is a complete sham, they just want your money and thus will reject the 'appeal'.

    5) If you don't take action on the ticket, the PPC will get the registered keeper's details from the DVLA, for a fee of £2.50. The registered keeper has no liability, since the presumed contract was formed with the driver. And, if you don't tell the PPC who was driving, they don't have a case.

    6) Ignore the ticket completely until they've bought your details from the DVLA (costs just £2.50) and write to the registered keeper. Opinions vary on whether to send a template letter in reply or simply ignore all correspondence, however, anecdotal evidence from this forum and Pepipoo indicates that with the 'ignoring everything' option they will give up after a few scary looking letters and false threats of bailiffs/CCJs/credit record entries.

  • Hi to everyone who has replied. I just wanted to say a huge thank you to all of you for taking time to respond with your fab advice - I have been spreading the word about these 'scams' to all of my friends and family as none of us have come across this before (as we'd never been fined). I will not be responding to them at all (unless you think I should respond once I receive their letter saying I don't know who was driving and unless they can prove who was then I won't be responding to anymore of their letters?) and I absolutely WILL NOT be paying them a penny!! I studied law a few years ago and although things change on a weekly basis, I am familiar with the basic civil court proceedings and criminal proceedings and now I know that I am not breaking the law, I don't give a fiddle, I will fight all the way!!

    Thanks again everyone. I will continue to tell people about this 'scam' in the hope that less and less people pay!! :beer:

    Nope, just don't respond at all, you don't owe them any explanation whatsoever, and it's not worth the cost of a stamp.
