DFS Lies

Hi,
DFS have lied to get me to purchase a suite from them.
On Nov 9, we went into DFS Chester and spoke with a sales person. My wife decided on the suite she wanted and we asked about Christmas delivery. The sales person said he could 99% guarantee delivery before Christmas.
Today, (30 Nov) I was called by the store and told that the suite is expected into the store Mid to End of January.
If the store could 99% promise it for Christmas, I would expect it to be a few days after at worst. All the store say is that they "tried", however they will not provide me with details of the supplier to call and confirm that there was any such request.
Also, a few things Tony (Salesperson) said to me:
1. as I was sat placing the order...I will push this button and they will start making your suite tomorrow.
2. during a future conversation he said the suite was made in Lancashire, and takes 1 day to make. He went to the factory a few weeks ago and it is amazing how efficient the process is.
So, if it takes only 1 day to make the suite, and it is not due until mid January, cancellation should not be a problem.
What right do I have to Cancel?
Furthermore, Tony gave me the store copy of the finance documents. He has requested that I return to the store to give them to him or post them. Does this bear any weight in cancellation?

Hi Jeffo,
I have no clue about your cancellation rights, not having bought a sofa from dfs... have you checked the t&c's of the agreement you, presumably, signed with them? Did you ask about cancellation when you placed the order? Have you contacted them about cancelling and what did they say?
I don't really see any evidence to show he lied to you. It was clear there was a chance that you wouldn't get the suite before xmas and you took the risk (i know, not what you want to hear!). I don't think the other things that Tony told you have any bearing on anything really...
First off, check your terms and conditions. See what rights you have to cancel.
Second, maybe try calling the store and asking them about your rights to cancel.
Hope that someone is of more use than me to you!0 -
You don't have any cancelation rights as you bought in store and were able to see what you were buying, these things happen, they can't always deliver in a specified time. Sorry xx0

The sales person said he could 99% guarantee delivery before Christmas.
There was your mistake. He didn't actually say it would definitely be available before Christmas. Unless you are told 100% it will be available, it's just sales patter and worthless. These people are on commission and will say whatever is required to get a sale. As long as they don't tell you outright lies, there is nothing you can do about it.0 -
If its made in Lancashire, its probably made by Buoyant..
Google them..0
