Where do I stand..

I moved out of a property on the 1st November but my contract wasnt up till the 7th January. I organised with the agent that I would continue to pay the rent for the rest of the contract length as I knew I was liable.

However now they have moved someone else into the property. Can they still expect me to pay rent on it when they are getting rent for someone else in the property.

Ive spoke to them and they just said they will speak with their legal team. Anyone know where I stand on this.

Also they said I will be charged a letting fee for the new people that have moved. They said it was because the owner of the property has had to pay another agent fee to get new people to move into the property. Surley that isnt my responsibility?

    Did you hand the keys back and pay the remaining rent up front to end the agreement. Or did you out of courtesy let them know you were not occupying it but intended to pay the rent until the end of your contract on the same basis as you had been?

    I think if its the later you still have the right to live there until 7 January.

    But I'm no expert, hopefully somebody will be along shortly to confirm your rights. Also is it worth checking your tenancy agreement to see if its a requirement that you have to occupy the property. I know they often say things like keeping a regular temperature with the heating etc, which implies you need to occupy.

    if a LL agrees that you can leave before the end of the fixed term, then s/he is perfectly entitled to ask you to fund the cost of them finding a new tenant .. that seems eminently reasonable to me ...

    the LL is also entitled to ask you to pay rent UNTIL a new tenant is found

    Write to them and ask for a refund of rent from the date the curretn tenants moved in
  • Thanks for your advice. The agent just called and said im only liable for the rent upto yesterday which is when the new people moved in. So its all sorted.
