URGENT ADVICE PLEASE - Car Purchase

I purchased a second hand car from a local trader - who by the way was listed as trading standards approved". Within 24hrs of getting the car home everything we purchased the car for and that was listed in the advert went wrong:


LPG - not working at all
Central locking - bodged to make it work by garage (as per our mechanics report) and now has deadlocked on passenger side and does not work at all.
Radio/CD - radio not working at all as suspect aerial fault



As soon as all this was noticed I complained to dealer and said I wanted full refund for return of car - he said he would give me £50 compensation. Then he said he would fix central locking I refused - he had already bodged it once and asked him if he was also going to fix the LPG which we had been told would cost us approximatley £2,000 to sort out?


I went to barclaycard as I had paid for it on my credit card with the following advice from this website:



"If buying from a trader your rights are the same as always. However certain factors must be taken into account. A car should be fit to use on the road, be in a condition that effects its age and price and be reasonably reliable. ‘Sold as seen' has no basis in law, your sale of goods act rights still apply".


Barclay card after 3 months have finally said they will not uphold our claim for refund and we owe them the money because the invoice states "sold as seen" on it! Trading standards will not get involved as they have no power of enforcement.



What can I do now I have a car that I can not use and have never been able to use since 1st August it would not pass an MOT and will cost me nearly £3k to fix.

    The car is still required to conform to the Sale of Goods Act 1979 which includes the requirement for it to be of satisfactory quality.

    Were any defects pointed out to you prior to purchasing?

    if sold as seen you couldnt possibly know about some of the faultls, and as he didnt point them out, he has breached the contract under soga. simple as

    As you seem to have gone through through your credit card companies process your next step would be to complain to the Financial Ombudsman

  • It sounds like the the credit card company are trying it on as much as the dealer.

    I will ask though - did you pay a fair price for the car? was the car advertised as being LPG?

    No they were not

    Yes the car was the correct price for what it was we didnt get any kind of deal on it and yes it was advertised as lpg thats why we went for it.

    In which case you need to go back to your credit card company but firstly, I'd go to consumerdirect. See what they say but I certainly wouldn't be giving up - I'm not an expert so not sure of the "sold as seen" angle but I thought it was essentially a smoke screen and not recognised in retail law.

    Its a mg zr 53 plate and sorry i really don't know what lpg kit is fitted - that's my other halfs department!!!
