Volkswagen Finance - any advice please?

    Hi there
    I wrote the first letter to Volkswagen Finance & they came back to me saying that the couldnt undestand why the complaint was bring made now ehen the loan was taken out in 2003 & finished in 2007 & that basically they werent at fault.
    Basically this is because not everyone were aware of the mis selling of these policies until recently, so do not worry about this one.

    I sent the second letter & today I received a reponse saying that Volkswagen never insist on payment protection being a compulsory part of the provision of credit. A standard response.

    They go on to say given the time that has passed since the loan agreement was signed they cannot comment on conversations that took place at the time of signing. Again standard.

    They also say that the PPI is optional so basically it was our choice to take it as the retailer is "well aware of this so there is little value to "force" you into the agreement. A fob off response, many receive an outcome like this.

    They finish by saying that this is their final response.
    Did they suggest the FOS in their letter?
    Yes I would ask the FOS are they able to investigate this for you, give them a ring first to make sure if you want to.

    SO basically I am wondering if we should go to the FOS? How do I prove that we were forcibly encouraged to take this PPI? They say they have no proof of the coversations so bacially its our word against theirs? The amount involved is £969.60 plus interest?

    Any advice from you knowledgeable people please?!
    Its always a matter of their word against yours, stick to your guns with this and ask the FOS if they are able to help, if so you can either ask them to send you the complaints form, or download and print one from their website here:

    Enclose copies of any correspondence and anything you may have to support your case, but I would ring to check with the FOS first, as they may the finance company were not regulated as such by GISG where the FSA taken over in Jan 2005.
    If the FOS are unable to take over this complaint, let us know and we can see if there are other ways around this one.

    They did say at the end of the letter that "despite yhe fact that the FSA regulation was not in force, you may still refer your complaint to the Financial Ombudsman Service under the Complaint transitional order".

    I'll print off the FOS form & give it a go! Thanks!
