    With the changes to State Pension from 2010, HRP Class 3 credits are now awarded instead of the previous system of reducing the number of years.

    Its not April 2010 for a few months yet and class 3 credits dont count for JSA/ESA which is why I would still advise claiming ESA in order to get maximum protection.

    If this is the case then his income will be taken into account as he is still contributing financially to the household and so you are still living as husband and wife even though he is in a different country.

    You will need to declare all income as well as the costs you have here for the DWP and HMRC to assess if you are entitled to any further benefits. It might be worth going to see the CAB or your local council and asking them for a better off calculation as they will be able to run through different scenarios and tell you if you are better off.

    From what you have said then I agree with the previous posters that ESA is the thing to apply for, it gives you a top up amount after they have decided how many hours a week (if at all) you are capable of working. They will also help and support you back into work.
