Mobile phone contract

Hi everyone

on 25th october I upgraded with three and got a nokia 5800. In the last 2 weeks the phone has broken, the dialler and contacts on the home screen do not work, nor do any of the widgets or memos. The phone is running really slow and keeps freezing.

I rang customer services this afternoon and I spoke to a really noice guy, who said that I could not exchange it for another phone, but could send me out another 5800. I asked if they could charge me more for the contract and give me a different phone entirely, and he said no. Then he told me that the phone was out of stock! And to call back at the end of the week.

Now I've had chance to reflect on this, I've decided that I really dont want another 5800 as i feel that the quality is really poor, and I dont trust them!

Am I within my rights to go back to the shop and reject the phone as it was not of merchandisable quality, and get them to cancel my new contract and start the upgrade process all over again so I can get a different phone? Im hoping to get this resolved at present as at the moment I do not have a working phone! So any feedback tonight will be gratefully received.

    You are rejecting the phone as it's faulty, and the shop are correct in giving you a new one of the same model. If it's out of stock and the old one can't be repaired, then perhaps you could ask them to refund the cost of the phone so that you can buy a new one. That depends on how long it's going to be out of stock for!

  • Well they said to ring back in a week and see. They did offer to fix it but said it would involve sending it away for 4 - 6 weeks and i need it for work, so I said this was not a suitable option.

  • I've just done a quick google on Nokia 5800 to see if there were loads of complaining threads but there aren't.

    I think you're jumping the gun a bit and you simply received a "friday afternoon" handset - I'm sure the replacement will be fine, but advise them that if it exhibits any of the faults you have experienced, you will reject the phone and demand another model - put it in writing to them.
  • I guess im just a bt fed up of having a faulty phone, but i got a 5800 because my dad has one and i was playing on his and it was fab.

    Because the call centre did not have any in stock, is it worth me going down to the local store and seeing if they will exchange it, or do i need to do it via phone?

  • Worth a try but I'd call the store first to save the trip - some companies operate the high street shops and the online / telesales setups as 2 different entities. I've got a feeling 3 will probably operate like this. Personally I'd hang on for the new one.
  • Yeah i have got pneumonia, and it is cold outside, im just desperate for a working phone! :-( But your right again, i should stay indoors and wait for the new working one to come through the post.

    Sorry about your situation. I have a similar problem with a Nokia phone I got fromO2. Very poor performancebut they will only repair or replace. I have given up on it and I am getting a new phone as I am stuck with the contract.

  • I know a couple of people that have had a few 'quirks' with the 5800. Many have been resolved with a couple of firmware updates. Not all networks allow the possibility of updating the phone with the 'generic' Nokia firmware & are a couple of revisions behind.

    If you don't have any joy with a replacement, or it's going to be a long struggle, it may be worth looking into.

    Mine used to be a little slow, but there was a firmware release that I downloaded last week, and this seems to have got the bugs out of it (although it did try to change my internet settings away from wifi)

    I do it all because I'm scared.
  • My dad had an issue with his. It would appear on but nobody could call in and he couldn't call out. He was going to send it back, but he did a clean install before then - reset everything down to bare bones factory settings (more thorough than through the option it gives you - google to find out how). Turns out it seems that there was a problem with Oranges settings on the phone. Phone is fine now and Dad is happy.
    Might save you a bit of trouble if you try it :)
