Made redundant - appealed successfully - now what?

    daphnelaurier - I suspect from the tone of your letter you are not surprised by the outcome, however, and it is entirely up to you, you could pursue the matter, and don't forget to appeal (again!) as this is a must should you do indeed decide to take the matter to the next stage.

    The reality is that the company will not want to defend any tribunal.

    Your post seems to suggest that you have lost points on subjective criterion in a selection matrix. Have you received any appraisals from the company?

    If there were 'productivity issues', this should have been mentioned in an appraisal and monitored, however, if the company had not indicated to you regarding your productivity, you were not in a position to rectify it.

    My concern would be the selection matrix has been 'tailored to fit' your rivals.

    By suggestion that by giving someone points for "future prospects within the company" is downright subjective and totally inappropriate for a redundancy selection matrix.

    Incidentally, was the format of the selection matrix discussed with you prior to scoring or was it agreed with any workers representatives?

    If you refer to my post in this thread (#6) regarding the notes from a meeting that stated you would be made redundant in any case, unfortunately, as I did suggest what would happen, your HR have denied all knowledge of this and suggested this was a misquote. How surprising!

    Even if you have no intentions of progressing a claim for unfair dismissal, I would suggest you appeal or put in a grievance against the selection matrix used in any case.

    Your feelings could change within the three months you have to take the company to tribunal.

    By winning an appeal and still being made redundant would certainly go in your favour.

    Whatever you decide, good luck anyway.
