Unfair Treatment from Landlord

If you were served notice in July why are you still in the flat??Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

Maybe the landlord just wants a nice easy life without a tenant constantly moaning to him about people flushing toilets and getting lawyers involved to back their case...0

What would you do if you have endured about two years of constant tobaccos and Cannabis fumes and noises of flushing of toilets and blocked drains in your bedroom for two years percolating into your flat? I do not think you will be laughing if you were suffocation in that awful odours.
I wouldn't be laughing; I would be moving! Why on earth do you want to stay if you hate it so much???
Would you move out, sell your flat., put up with the crap from the landlord. Why should I pay the penalties. You made it sounds as if it's easy to pack up and move out. Try to put yourself in my position. Then you will understand.
So in other words the landlord is right and he rather have criminals living in his property than law abiding citizens.
I've moved 17 times in the last 12 years, and moving really isn't that difficult. Scrounge some cardboard boxes, and go to a cheapo Christmas shop to get parcel tape, then just box your stuff up.
When they issued your notice period, you should have been looking for somewhere else to live. As you hate where you live so much, then I would have though this would have been something to look forward to.
I would suggest re-reading post 2 and following up those links, along with looking for adverts in local shop windows, checking they accept housing benefit.
Ultimately, beggar's can't be choosers. The LL wants the property back, and it's not yours to keep.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
The OP was advised how go about resolving the situation months ago. They have chosen not to act on any advice or to try and find alternative accommodation and now it's everyone else's fault. Got it.0

Thanks for rubbing salts in my wounds. I have been looking for other properties to rent and a lot of landlords did not want to take Housing benefits and also they want Deposit not Guaranteed Deposit. I went to the Local Authority early this year and even my doctor wrote to them about the problems which have been affecting my health and they replied "Why do you want to move out and why are you making yourself homeless" You need to raise your own deposit. I even got this in writing from the Local Authority. I totally understand they do not have to help me, so in other words I have to shut my mouth and put up with nonsense then I won't be homeless. Get real!!!!!!
Try to put yourself in my position with no family support. The Agents have got a habit of giving an AST Contract and then kicked tenants out before the six months. They did it to me in 2006 and forced me into this property. I am not a ball for kicking about.0 -
Agents can't legally evict you within the six months of an AST without you having breached the tenancy agreement, and why would they want to anyway as they will cut off a revenue stream??Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

Well that's what happened to me in 2006. I was still within the contractual period of the AST. It was no fault of my own. The landlord sold the flat and he wanted me out. He orginally put flat on sale and said that I did not need worry as whoever bought flat will keep me as tenant. The landlord served notice two months earlier and continuously harassing me, phoning and visiting the flat for me to move out before the six months. The Notice was defective. Obviously then I did not know my rights and since I was on my own, fear of my safety, as the landlord was a thug and I gave in. Both the landlord and Agents made a mockery of Contracts. The Council did nothing to help.0 -
You said "the agents have got a habit of giving an AST and then kicked tenants out before the six months" what actually happened was the landlord gave you notice in 2006 and harrassed you until you left. Why blame the agents??
Again in your original post on this thread you note that the landlord gave you notice to quit in July but then threaten "naming and shaming the landlord and the agency". You give no other indication that the agents have treated you badly - hardly fair.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -

Yes they kicked the previous tenant out who was still in contract period. Both Landlord and Agent harassed me, phoning and making visit to property. The agent told me once which now I kicked myself of how did i believe such crap "If you do not move out, the new tenants will move in with you". The new buyer had keys and let himself in while I was in. I had to call police. Notice served was defective and I was out in less than 2 months, the tenancy has not run out.

Agent to blame as well. Only met Landlord once as he said he intended to inspect flat with his own key with surveyor. The Tenancy Agreement was preformulated and contained unfair terms as per OFT. The Agents signed "on helaf of landlord". Agents knew of noise and smells as they had received complaints from other tenants, they even came to flat to witness smell which they admitted but later denied.

I can understand this is an emotional time but that doesn't change the fact that this landlord has served you notice correctly and the court has granted possession of the property. That is the landlords right as the owner, there doesn't have to be any fault on the tenants part, as schedule 21 notice is a no fault notice.
I have been in a situation with nightmare neighbours and the solution if it can't be resolved is to move on.
In the case of your neigbours flushing the loo and other domestic sounds are annoying you due to poor sound insulation and this is not the fault of those neighbours. The cannabis thing is illegal but unless the police are willing to act then you have no recourse. I would say that there are much worse things that neighbours can do.
What have the council said now your are being made homeless involuntarily ?0
