Hi
I am looking for some advice.
I recently booked a limo hire over the telephone for a hen night - the number was given to me by the hen who was using the same limo company for her wedding. I booked it on the Monday for the Saturday night - I was asked if I wanted to pay a depost or full, I opted for deposit of £100 which I paid on my debit card - the lady said they would contact me for further payment.
I checked my emails on the Saturday in which I had a few confirmations with different deposits paid. I contat them as I had not heard from them and they advised they had cancelled the hire that day (day of hire) due to full payment not being received. It was only on the phone chasing up the limo they said their terms were they would take full payment. They had kept my card detail and took a extra £200 without me knowing about the addition transactions or these terms which then also took me into an unorthorise overdraft.
I did write to them in which they said they have full rights to take additional payments from form card!! - Is that legal to keep my card details and take additional payments?
I was not aware of the terms which I don't think again covers anything for late bookings - Can someone please help?

No its not legal as described - its essentially theft.
Difficulty will be proving what you authorised them to take if it was done over the phone. If you can prove that you only authorised the £100 deposit, then I'd threaten them with the Police and/or liaise with your bank.0 -
I'll speak to my bank today and hopefully I can get somewhere - I will keep you updated Thanks0

Virgin media did that to me!
Because of various !!!! ups by themselves, they offered me 6months totally free broadband but then because of more cockups I reported them to CISAS and they decided to help themselves to money from my card details which they kept from when I was a customer from 3 years ago!!!
I had not even given them any bank details this time as it was free service so it was just chance I had the same card! I had not even signed a contract with them sooooooooooo
I rang my bank and explained and told them I had proof of emails from Virgin offering me free service and the bank repaid me fully there and then! They said they will claim the money back from Virgin.
Now waiting for Virgin to cut me o.....................0 -

Not really, in all hire agreements you tend to see an initial payment/deposit followed by a balance on use.0 -
They took the additional payments as they said it was their terms and conditions - these terms and conditions I was not made aware of over the phone at all when I booked! How can they then take the additional payment. I have contacted my bank who are looking into it but they said it could take upto 8 weeks - they didn't even take any other information about the company etc!
Is it worth asking for a telephone manuscript or recording of the call?
I can't believe that people can get away with scaming you out of money0
