As its coming up to Christmas I need to send some prezzies. I am English living in Spain and my wife is Danish. I found some cd's for Danish relatives on Play.com because they advertise free european delivery on all items and went to checkout to pay the £15. I want to pay in pounds using a uk card and bank, but play.com refuse to send them listing an unspecified problem. If I change the payment currency to euros though and try to pay with the same card and same bank the problem "vanishes" but by paying in euros the items become more expensive at 21€ which is a big difference. The Post Office quotes me 16€ for £15.
Is this legal?
They are forcing me to pay in a certain way (as i would prefer to pay in pounds) then charging me extra, isn't it illegal to discriminate how much you charge depending on where an EU citizen lives?

Yes I already tried that they fobbed me off with "website problem will be resolved shortly" which of course it hasn't. What I would like to know is "Is it legal to charge someone more depending on where they live in the EU" particularly as they offer free postage. If it is or not can you point me in the direction of the correct legislation.

I'm fairly sure that the Play.com T&C's say that anyone living in and ordering from Europe will be charged in Euros.import this0

This affected me when I was living in Europe. Regardless of the fact I was using a UK card it was the delivery address that gave rise to the charge in €. Their exchange rate was far worse than any other I used e.g Paypal, Amazon US.
It made me weigh up purchases from other retailers such as Amazon, HMV much more seriously even with postage costs. Play lost a fair amount of my business because of this and lately other matters.
As they are based in Jersey then I suspect that there will be no law covering the application of exchange rates on overseas sales (as indeed there is none in the UK). As laurel7172 points out, their T&C's state the terms for European orders.0 -
Is your card registered address in Spain though, maybe thats the problem.0
