Reclaim Court Fee for reclaiming?

As the small claim court haven't done a bean of work in handling my claim does that mean I claim my £80 fee back?
I applied online and my claim was put on hold and refered to my local court who the said all claims are on hold... Surely they haven't earned my £80 fee?

How the hell do you take a small claim court to court to get your money back? ha ha!

    I think you can kiss goodbye to your £80 if the basis of your claim was made on the template letters that were previously available on this site.

    You could try to sue Martin Lewis on the basis of loss due to being given poor advice.

    If you Particulars of Claim has UTCCR 1999 then it is still a valid claim and so far the Master of Rolls for civil courts has yet to give guidance to the courts. LloydsTSB are the only bank currently looking to strike out claims. The validity of your claim still remains in tact so do not do anything quite yet. The wording of the stay should give you 28 days from the end of the case to need to do anything. At the moment it is day 3 so hang fire for now.

    You are not in a contractual basis with Martin so nothing to hang a claim on.

    Even if you were I'd doubt there were any valid claim.

    The court of lodged the file and time has been spent dealing with it even if it hasnt got to where you want it to go.

    Court action is not risk free and not cost free. You pay your money and you take your chances. If you lose, then you may end up out of pocket.

    Yes it would all depend on the basis of the original claim.

    However, I suspect many MSEers who made a claim used the templates that MSE made available.
