I sold an item on ebay 3 weeks ago. After th ebuyer received it she asked for a refund as it was smaller than described but she wouldnt return it.....
She then did a claim through Paypal saying "ITEM NOT RECEIVED" :mad: I forwarded all emails to paypal and they still awarded in Her favour
2 days later she sent me a picture of my item beside hers to emphasise the difference and she stated in email that it was my item....
Forwarded email to paypal to prove she had received item but cannot open case as no tracking info :eek:
Any ideas as she in my eyes has committed fraud

Send a formally worded letter + invoice by recorded post requesting payment or return of item within 7 days, as you will be commencing legal procedings after that time.
Alternatively, RING paypal until they start talking sense - email will get you nowhere but you might be able to get a decent human being on the phone who is willing to treat it as fraud.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
If you don't have a tracking number then PayPal will find against you.
I agree that this sounds like fraud. Forget PayPal and take her to court.0 -
What a cheek sending you the photo as well. I'd be fuming. Sorry I can't give you any advice but I think is disgusting that paypal ruled in her favour after she emailed you.0

I think the problem is that PayPal don't have the time (or don't want to spend the money) manually investigating each case.
If you've got a tracking number then it can be electronically verified and that's job done.
This has gone beyond PayPal. The only people able to rule in your favour are the courts.0 -

Paypal seem to employ only robots following a script.
I had a buyer complain about an item. He refused to return and then went to Paypal for item not received. he even wrote in his written information on the dispute that he had the item. I rang and emailed for days but they found in his favour.
Only when I threatened them with the UK financial ombudsman did the money reappear in my bank. I really think Paypal paid it because I never heard from the fraudster again.0 -

Small claims is your friend here.
I agree with above poster who said strongly worded letter, sent special delivery ('cos recorded don't actually get a signature half the time) stating that you will commence legal proceedings after 7 days - and do it. Point out that as well as the cost of the item you will be seeking to recover court costs, legal fees (if any), admin costs and your labour @ £x phr (keep it reasonable). It will cost them more than £15.They deem him their worst enemy who tells them the truth. -- Plato0
