Capital One help!!

I recieved a reply today after writing to them to reclaim PPI charges, stating I'm not entitled to claim as I chose to take out PPI. I never knew I was paying this until a friend mentioned about the claims, and on checking my credit card statement found it had been deducted every month since 1999!!! I knew for a fact I hadn't taken it out as I never do!

This is the interesting bit ...... they have enclosed a copy of the original agreement. The box where you would tick No thanks has been totally scribbled out (making it look like I have ticked it then changed my mind!) and the box agreeing to PPI has a large black tick in it!! If I ever make a mistake on a form I ALWAYS put a cross through the mistake and my initials beside it. They have blatantly scribbled out the no box then ticked the yes box! The problem is, how do I prove what they've done?

Any advice would be appreciated.

    Well in my opinion they certainly put themselves in it, and its proved on your statements as well.
    May I ask what finance company this is, is it a bank?

    I would jump hoops here, ring the FOS and ask if they can help on your behalf, where they will write to the company for you, get some photocopies done of the documents you have such as the statements, and the agreement and explain as you have done above.

  • Hi thanks for your advice. It's a Capital One credit card I have, I've had it since 1999 and been they've been taking the PPI off all that time ! I'll follow your advice and keep you posted.

    Hi

    Have you got any further with this yet? I am in a similar position with husbands claim having just received copy of the agreement with a tick in PPI box which is very different to the others he put on the form. Positive this was not his tick but not sure how to proceed.
