    It doesn't say that at all, what it does say is that cancellation must be done in writing.

    Section 7.6.1 then goes on to state:
    7.6.1 Email webshop@mobilephonesdirect.co.uk or telephone 0845 470 4000 to obtain a returns Authorisations number (RAN).

    Which I've done both. Through email they've ended it with a 'Please confirm that security seal is intact.' I've replied that it isn't, but shouldn't affect my right to return and since then I've heard nothing. Telephoning them yields a dead end with a pre recorded message or constant dialling until it disconnects.

    Well then just package the phone back up and send back to them regardless with a note inside stating again that you're returning the item under the terms of the Distance Selling Regulations 2000. If you then haven't recieved a full refund within 30 days then start county court proceedings.

    If greater than £100, and on credit card, you can pursue them through your credit card company - simply speak to your card company and request that you intend to make a Consumer Credit Section 75 Claim and why.

    Just to add, by a trackable and insured method to the 'phones value. ie. RM Special Delivery or a parcel courier service.

    I've paid by debit card unfortunately. There's also the matter of the mobile phone contract the phone is linked to. I'm well aware it was a silly move to purchase by debit card.

    This morning I've received an email back saying that they've received my letter and someone from management will get back to me in 5 working days (so sometime this week).

    I'm hesistant to just send the phone back without a returns authorisation number since I think they will just refuse delivery and it will waste time and money. Consumer Direct have told me to hold off sending the handset back until Mobile Phones Direct authorise me to do so.
  • How did you get on with regard to returning the phone to MPD? I'm in the same situation, bought a phone on contract which doesn't meet my needs.

    Phone was attempted delivery last Friday (4 Dec 09), picked up and signed for on Tuesday (8 Dec). Doesn't fit my requirements, as I've got to have better sat nav, and it's bulky and heavy. And the contract is too expensive to justify these shortcomings. So according to their return policy I can send back within 7 days of receiving.

    Every day I've tried ringing the 0845 number but no answer. I emailed them Wednesday, Thursday, Friday. On the Thursday I rang Nokia Retail in Newbury. They couldn't help and gave me a direct MPD number. This went to the shop floor, the guy who answered said he couldn't help cos it wasn't faulty. Said the only way I can get an RMA is to email them. He said he'd email them too. I rang T-mobile on Thursday too to notify them of the situation and they made a note on my account that MPD were fobbing me off, as evidence if needed later, but as it's through a 3rd party they couldn't cancel the contract.

    Still no responses....and no answer on the phone this morning. What can I do?:confused:
