Problem with Roof on Neighbours Garage

Not sure if this is the correct place to post but it seemed the most suitable.

My mom lives in a bungalow with a detached garage. The detached garage is linked to her neighbours garage and they share the internal wall.. Shortly after she bought the bungalow the roof blew off both of the garages and she paid for both to be made watertight whilst a repair was carried out - the neighbour was supposed to pay half but never ever did.

Mom claimed on her insurance for a new roof and it was replaced however the neighbour made do with the temporary repair which has now also blown away leaving just the joists. Water is now seeping through from the unroofed garage into hers and is making her garage soaking wet. What is the best course of action to take?

At the moment we are thinking of writing to the neighbour as they never seem to be in when we go round (they are corner properties so not really next door neighbours) to ask them to repair their roof as it is damaging her property but what happens if they still do nothing? Think we are stuck between a rock and a hardplace as she eventually wants to move and this may affect her selling.

  • if its afecting your mums property try the local council building department , as its causing damage to your mums property then they can make them get it fixed , i had a problem with my old neighbours lean to a few years ago , when it rained heavy the water would run off their roof into my yard and cause it to flood , they didnt have any guttering on their lean to hence my flood , got in touch with council as neighbours were erm horrible !!! and nice man made them fix it under some law about somthing or other ????
    when i say lean to think shanty town type thing , they had to re roof it to get guttering to work properly so it worked out great for me ..... costly for them

    give them a try and be nice to them :)

    She needs to tell her house insurance co of the full circumstances. They may then give her guidance as to the best course of action.

    It's nothing do do with the council unless it's a health hazard (e.g rats, ) or likely to fall down and injure a member of the public.
    Your mother should send a recorded dellvery letter to the occupants advising them that their neglect is causing damage to her property (give details) and asking them to put it right within a fixed period (say 90 days). If this produces no response then she should take legal advice with a view to taking a civil action against them.
    No free lunch, and no free laptop ;)
