Car right off - garage charging for storage?

I was involved in an accident not my fault. Car was taken to a local garage awaiting the assesor (insurance company informed of location). Car was declared a right off. I accepted an offer for the car and was sent a cheque.

I now (almost 2 months later) get a call from the Insurance company telling me that the garage will not release the car without the storage fee being paid, this amounts to over £1,000!!

Where do I stand here, surley this is not my problem. I was not told by the garage that there would be any costs incurred. The Insurance company knew where the car was being stored and I no longer own the car.

Is there any law which I am covered by?

  • As I understand it, the insurance company have paid out so the car is now their property.

    When did you inform the insurance company of it's location?
    At most you should only be liable from the recovery to informing them.

    Chippys right of course, car belongs to the insurance company, they pay the bills.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    Tell them to pay it then they can have their car back. Cheeky gits :rolleyes:
