    I doubt it... we had 15 cases where the banks contested by letter that the account would be closed out of spite', but 11 were monthly fee based anyway, and it was ruled that the bank was still capable of earning a fee from them and interest on the money lodged within the account. The other four were retained on the grounds that closing the account is an unfair principle, as the bank has never given notice of such intent prior to, and was therefore trying to close the contract out of pure spite, and was invoking a clause that put the consumer at a disctinct disadvantage. this si also against the Shcedule 2 examples of "restricting a consumer from exercising legal recourse".

    The UTCC Regs state that if the contract can continue, in the whole, to be operated, then individual clauses can be removed.

    Else, ask the judge to order the bank to simply enforce your equitable terms... that way their terms are still included, as are yours.

    You are offering the banks a simple solution, and the court has agreed with us on these cases.

    They cannot have it both ways.
