A little advice please

Before I start I would just like to introduce myself, My name (User) is baileym and I would just like to say hello to everyone on the forum

Ok here goes

I have been reading a lot of posts about a letter people have been receiving from TELOGRAM and I have now received one myself, 3 days passed and I have now received a letter from H.L legal saying I have until the 30th November to respond

Now looking at the letters I have received they look just as described on many threads and are printed on cheap paper and both letters have no signature so I am going to take a guess and say that they are both not worth the paper they are written on

Now the fun part, They are asking me to ring and confirm who I am which obviously after reading various posts I am not going to do, They have an address that I did live at but that was over 16 years ago and when I was at that address I had no outstanding debt (That I am aware of)

Now reading lots of posts on this subject I would like to ask a couple of questions please?

1. As I have not lived at that address for over 16 years would I be right in saying they cannot do anything even if I did have a debt (I am 99.9% sure I did not though while at this address)

2. Would it be advisable to send them a letter (I have seen a few on the forum) as I feel that this would confirm that I am living at the current address they are sending these letters to although it could also stop them (Not sure which to do)

3. Should I report these letters to the OFT and Police?

Although I am not to bothered right now this is obviously a little worrying not just for me but for everyone who receives these letters, I can do without this kind of hassle as I am sure we all can and I am a little concerned in case I start to receive phone calls and people arrive on my doorstep uninvited

I understand that no one can enter my premises without a letter from the courts and I would have to be notified first but all the same it does bother me a little I have to say

I would appreciate any help on this matter and would like to thank you in advance

baileym

They're fishing letters by the sounds of it - ignore then - nothing to report to the police and not yet anything to report to the OFT.
They can't arrive on your doorstep unannounced - they have to make an appointment. Just because they have your address doesn't mean they have your number and if they call then send them the "call me again and it's harassment and I'll report you" letter.
The procedure to enter your property is a LOT more complex than getting a letter from the courts and the debts if they ARE over 16 years old would be statute barred anyway so don't worry and ignore them.

  • I does sound very much like they are chancers to be honest. As far as I know they can't chase you for a debt unless you have a CCJ. It might be worth checking your credit files just to check there's no problems on there.
I am not sure what to do with the letters I guess either ignore them or send them a letter stating unless you prove I owe you money then go away- there's a template on here somewhere.
Hopefully someone will know the answer for you though.

I do not have any CCJs im sure of that and I did check my credit file earlier this year and there was nothing on there that should not have been.

From what i have been reading if it is a debt that was a long time ago it may not appear on my file (Im not sure if someone could clear that up for me)

If i had CCJs then surely i would know about them by way of a letter from the courts would i not?

Most entries stay on your credit reports for 6 years (although searches only stay on 2years).

So if all payments/the default etc were made more than 6years ago they will no longer appear. Which also means they will most likely be statute barred.

If the letters you have recieved give details of a debt (amount due and account number) then you could send the statute barred letter - http://forums.moneysavingexpert.com/showpost.html?p=11571227&postcount=3
If not then just ignore them.

The letters i have recieved do not say what the debt is or how much it is for, I have only been asked to contact them and prove who i am.

Sounds very odd to me and it does sound like a lot of the letters people have been talking about on here before me.

Then they are just fishing letters - ignore them altogether - no one will turn up on your door - they are probably sending these letters out to 10 x Mr baileym and 6 x Mr baileyp and 3 x Mr bileym (if you see what I mean) so its not cost effective for them to turn up on people's doorsteps but its cheap to post out 20-30letters and wait for someone to contact you.

That is great news and thank you all for you replys, I shall await some more letters as i feel this is not the end. From what i have been reading i have had a letter from TELOGRAM and now one from HL LEGAL so i am going to take a mild guess that the next one that comes through will be from CAPQUEST

I shall keep these letters just in case i need them though.

Ok a quick update as to the letters i have been getting, I have not replied to any of them and so far one from Telogram and one from HL Legal and now today i have 2 letters arrive.

The first from Abbey saying they sold my account on the 3rd July 2009 and i did not know anything and they have said that i owe £109.97 although i have not had an Abbey account for well over 8 years plus i did not owe them any money

Also a letter from CapQuest telling me they have purchased the account and are now seeking payment but (And this is the fun bit) they say that they will accept a final payment of £54.99 and if i pay that by the 11th December that will be that but if i do not then i am liable for the whole £109.97

Now i have not contacted these people and have no intention to unless someone on this forum thinks i should

From what i can see it is a scam and i have no intention of paying them a penny, Am i doing the right thing or can i expect someone turning up on my door soon to collect

I feel that Abbey should have told me about this if it is true and i certainly should have heard by now as they were supposed to have sold my account in July

    Any ideas people

    Best regards

I have a quick question if someone could please help

I was going to ignore these letters i keep getting but i was thinking of sending this letter http://www.nationaldebtline.co.uk/england_wales/factsheet.php#h

What i would like to know is who do i send it to, Telogram, HL Legal or Capquest as they all have different addresses?

I would appreciate some help please, Or should i just ignore them because if i send the letter they will know who i am?

    Hi bailey

For some reason I can't get through to the letter on the link in your post.

But I think you have a couple of choices -you could either ask them (capquest) to prove you owe them (and previously abbey) this money. Then if they can prove it send the statute barred letter.
Or you could just start with the statute barred letter (in effect assumingthat you did originally owe the money)

    Here are the templates
    http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2
    http://forums.moneysavingexpert.com/showpost.html?p=11571227&postcount=3
(I expect one of these was the same letter you linked to?)

Send the letters to capquest as they are the ones demanding the money.
