URGENT HELP needed. AVIVA are doing my head in.

This may sound a little rude, which is not my intention.
Suggest that you get on with writing the complaint letter, rather that debating what has happened and send asap by recorded delivery.
Obviously there was a problem of crossed wires with Aviva and it is up to them to sort the matter out for you.
I would suggest taking your insurance elsewhere, if dealing with them is going to be this complicated,

They issued the default notice, automatically i assume, upon receiving my phonecall on 31st October 2009. I hadn't even received any correspondence from them in relation to my new policy so I could realise the error.

You need to speak to them.
It sounds to me like you have contacted them to sort out the renewal(?). They have offered to backdate it as they will have realised at that point there is something odd going on and it should have been renewed, but may not have spotted the entire year missing previously.
So...they have told you they will backdate to 9th Oct or whatever it was PRIOR to someone noticing the other missing cover.
This is where it gets a little more complicated. It may be they have offered your renewal based on you being on cover for the missing year, and having seen the gap in cover, realise they cannot just renew you this year due to system or accounts issues . This may be why the DD has not gone through yet. They may not be able to renew the same policy with arrears in payments (computer says 'no').
Ring them now and confirm you are on cover. If not, insist a new quote on a new policy, exactly the same as last year with a years NCB chucked in for free for your trouble.
If you want cover for the missing year but cant pay in full, request a separate DD for that. If you don't want it, just point that out and suggest it would be in everyone's interest to just ignore the missing year.

I keep being told I haven't had a break in my cover. Each person I speak to cannot comprehend that my phonecall on 31st Oct 2009 triggered the previous years policy and default notice. Yet on 31st October I was told my policy was expired, but wasn't told it had expired the previous year. They are going to investigate. I'll see what happens when they call me back, if they call me back, on Monday.
It's beyond their understanding why I never received any mail between my renewal reminder in Sept 08 and my phonecall on 31st Oct 09. It seems pretty obvious to me. They'll have to go back and listen to the phonecalls. Whether I'll have a positive outcome is a different matter.
They say my policy is still in force.
Beginning to wonder if I should just pay up. although it keeps coming back to if I had to claim when my policy was expired, would they have paid up. I think not.

You say the insurer never sent a reminder? It sounds like Aviva have offered to cover the period of no insurance for free and asked you to start paying for the 2009 renewal to cover this term.

You cant backdate insurance for cars as its a legal document. Technically you cant backdate for anyother policies except for special circumstances like this one. I can see why they did it like some one pointed out there may be an underlying subsidence problem which you may not be aware of yet.
From the sounds of it this policy was on DD up until october last year and majority of companies when on DD will auto-renew and the adviser may of spotted a mistake on their system that it should of been auto-renewed and wasnt, so he/she may of had no choice but to backdate it. If it was their mistake then maybe an agreement with the money should be arranged between yourselves.
If a claim did happen technically you wouldnt of been covered and you are correct there but if then it came to light a mistake happened on the Auto-renewal then they prob would of covered you after investigating.

I suspect that the issuing of a default notice may well have triggered an entry on your Credit files with Experian, Equifax and CallCredit0 -

If you chose [or forgot) to renew by October 2008, why would you expect Aviva to send a second reminder? Aviva are not going to waste money sending second reminders when, in all probability, most people who do not renew have died, moved house or simply gone to another insurance company!0 -

Firstly Mr Varjak, I FORGOT. I wouldn't expect them to send me a second reminder. My point was that they would have sent me a reminder had I been insured, which they say I was.0
