Termination of Contract letters

My job is being transferred from one company to a different company, Ive been told to sign a Termination of Contract letter and its to be dated effective 4th Dec

This means my current employers will pay me a salary for 1st Dec to 4th Dec then new employers pay me from 7th onwards.

I wanted a bit of time to myself so amended my Termination letter to 30th Nov therefore leaving a week early and taking no salary, employers have said no we wont allow it.

Do I have any way of appealing?

Is this a TUPE (Transfer of Undertakings) situation?

IF you are an employee of company A and your job is now transferring to company B you are covered under TUPE. However, in your query you are not challenging the legality of this but the legality of making you terminate your contract early to allow unpaid leave. Basically the Company can insist on you giving your contractual notice and if you decide to go early you may terminate your right to transfer to the other company under TUPE as you will have been deemed to have resigned without notice.
