LA Fitness Complaint - advice needed!

Options
Hi All,

I recently joined La Fitness and am disgusted by the service (see email below). To prompt a response from them I cancelled my DD. I'd really appreciate any advice on this and if anyone has any idea where I stand legally I'd love to know!!
The 1st complaint is dated 4/11/09
Thanks!!

To Whom It May Concern,

I am resending this complaint to you as I have been informed by Member's Services this was never received despite the fact I received an automated response.
To add to this I have still not received a copy of my contract from Piccadilly and neither have I received a call from the Club Manager, Johnny, despite leaving a message weekly for him.

I am absolutely disgusted at the lack of service provided.

.ExternalClass .ecxhmmessage P{padding:0px;}.ExternalClass body.ecxhmmessage{font-size:10pt;font-family:Verdana;}Dear Johnny,

I am writing to you in regards to my membership with LA Fitness Piccadilly.

There are a number of reasons that have prompted my email, the main one being my contract. When I met with Taz he showed me around the club. He knew I was on a time limit and when we sat down to go through the details this was very rushed. He told me that the offer he was discussing was only available on that day and this was 2 initial months at £49 then 10% discount for every month after that @ £44.10. This has not happened and I have been charged £49 for the month of November. He also told me that I could freeze or cancel my membership at any time. In regards to the direct debit he told me it came out at the end of the month and I explained I was paid on the last day of the month and all my direct debits come out of my account on the 1st of the month. He told me this was not a problem. I have since found out this is not the case and the dd comes out on 30th - this meant I went overdrawn and incurred a £35 bank charge.

I was also told that the membership involved a one to one which I was able to book with Fatmir. Taz told me that regular contact would be maintained and if I hadn't been to the gym my nominated person would keep in contact etc. Fatmir did meet with me once and also did a meal plan for me however I have had no contact with him since.
I signed the contract with Taz as I was keen not to miss out on the offer and liked the club. I didn't receive a copy of the signed contract and it was all very rushed.
I have since requested a copy of this on numerous occasions and have only just been told they have that for me. I have been speaking to Hayley and she is aware of how long I have been asking for this. I spoke to her at 12.08pm and she promised to email me a copy of the contract and I still haven't received this. It was meant to be sent yesterday and wasn't.

My situation as of yesterday has changed at work and I've had to take a massive salary cut.
I explained this to Hayley today and she informed me that I could only cancel my membership if I was made redundant. I was led to believe I could freeze my membership and have just been told it can be frozen but I would still need need to pay each month. I was rather shocked to hear that and she also told me I would incur the full amount if I cancelled. If this had been explained to me in detail I wouldn't have joined LA Fitness as based on the current climate I would not have committed to a years contract.

Overall I feel the service I have received has been very poor and not at the level I would expect from a London club. I also feel that I was encouraged to sign the contract with very basic information and had I have had the full facts I would never have signed.

I would welcome your thoughts on the above and hope to hear from you soon.

Kind Regards,

Sam

Read the small print! Many gym membership 'contracts' take the form of a personal loan repayable over the length of the contract. A personal loan cannot, of course, be cancelled.
