Question on PPI response from Capital One

I have just received my response back from Capital One saying they won't be returning any payments as Ii wasn.t subject to misselling. They have sent a copy of my Application form which i posted off to them , and i have ticked the box saying 'Yes i want payment protection insurance'. I did qoute in my original letter that they were fined and they did agree on that.

Is my case lost or should i send the second letter anyways saying I'm not happy?

    Do not give up on this yet.

    This is just a standard fob off response, so if this wasn't the final response, write back and tell them you do not agree with their decision and want them to reconsider this, due to your reasons given on your original letter, tell them even though they supplied you with a copy of your agreement, this proves nothing, as you have your reasons.

    If this was the final decision then its time to move on to the financial ombudsman service (FOS), they should tell you this in the final letter with the details of the FOS.
    Give the bank 14 days as from this letter.
