Bank charges/credit card charges?

Ok like many here when i heard the news today my heart sank... but it lead to me think, how could a decision be made to have a maximum credit charge of £12 a few years ago yet not one on bank charges now (allthough i think the test case wasnt specifically looking at this). Is it possible to put a claim in asking for the difference with what they originally charged and the £12 ruling from the credit card case. I have no problem paying some charge for abusing my OD facility but it is hard to take when they are saying paying £35 for one is not right and it is ok to pay £35 on another.

Credit card charges was an administrative thing and the OFT stated then that only a Court can decide on what a fair charge under UTCCR. I believe that view is still the same and reclaiming credit charges including the £12.00 ones is still a green light to carry on.0
