Child Maintaintence question

X H presently pays half the mortgage for the FMH and 20% ish of his take home pay to support his 2 sons (11 + 2)..( but currently pays all of the mortgage..in liew of maint) as advised by CMoptions and DWP.
I am buying the FMH from him and he will no longer be responsible for the mortgage.
He is living with his new partner and her 2 sons ( 13 + 9)...her XH is paying a similar arrangment, allthough the figures are consibrily(sp) larger.
My question is.......if i was to go through the the CSA......would they take his partners children into account for the calculations.....they are hoping to move into rented accomodation soon as well, if that has any bearing on the result?
The reason I am asking is, XH has recently got a new job which I believe is at a higher wage than his last one, and he will not disclose his new income to me......
Also do the CSA take all his take home pay into account or just his basic wage....he has been doing loads of overtime.

1/ Yes, they would take his partner's children into account if they are living at the same address. They would give him an allowance of 20% off his wage before the child support assessment calculation.
For example: Net pay £1000 per month, minus £200 (20%) Assessment based on £800 per month. For your 2 children he should pay 20% of £800 -£160 per month.
He will also receive an allowance of one seventh off this figure for however many overnight stays per week your children stay with him up to a maximum of three sevenths.
2/ Accomodation has no bearing on the outcome as it is not included in the assessment.
3/ The CSA will take all his net pay into account, including overtime if this is shown on his 2 monthly wage slips that he will be asked to produce.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:

But he told me they could offset their rental off their income. So that was news to me, thanks.
As for his current wage I will be better off going through the CSA cause they will be able to ask to see his wage slips.
I am going to leave it til the new year then there will be 8-9 weeks of wage slips and the FMH will be signed over to me.

That was only on old CS1 cases that ended in 2003. As you don't have a case with them yet, it will be calculated under the latest rules which do not take living costs into account.Donedoingdebt Lightbulb moment January 2000. Yes but you'll also receive a proportion of their CTC and I assume as PWC you'll also receive Child Benefit, WTC (if working) and CTC which he won't.0 -
You may think you'll be better off on the CSA but at the moment he is paying 20% of his income ... going through the CSA, they'll take off 20% first, then he'll pay 20%. Don't be surprised if going through the CSA doesn't give you much more a month ... if any.August GC 10th - 10th : £200 / £70.61

I will have a think over the next couple of months while the divorce goes through..I am on IS at the moment, looking to go back to work in the new year.
