The title says it all, I'm completely confused by the different threads and opinions at the minute.
Can anyone tell me / us...
What now happens to all the cases that were/are on hold?
Under hardship claims are those being looked at or not?
Are the FOS still reviewing cases they already have or future ones?
HEeeelllpppp please :-)

(1) What now happens to all the cases that were/are on hold?
They will come back to life as the hold has been lifted. However they will probably be struck out by the court very quickly, because the arguments they are based on have now been found to be wrong by the Supreme Court.
There is a new argument that Martin is looking into - based on section 5 of the Unfair Terms in Consumer Contracts Regulations. It may be possible to amend your claim so as to rely on this new argument instead of the old ones. However you have to make an application to amend (there is a fee) and you would have to do this before your existing claim is struck out.
(2) Hardship claims are those being looked at or not?
Hardship claims are now in exactly the same position as anyone else.
(3) Are the FOS still reviewing claims they have or future ones.
Not clear. They say they are considering what to do. Watch this space.0 -
