broken pram...do i have rights

Options
hi

i bought a new travel system about 18 months ago, unfortunately part of the frame snapped the other day while i was pushing my son around a shop. as it is only 18 months old i don't feel this has had fair wear on it. it is not over used and in fact hasn't been used much at all. the manafacturer has said as it is no longer under warrenty then there is nothing they can do.... do we have any rights to get fair wear out of items? is there any case i can plead i have just become a single parent and can't really afford a new one.....

thanks for any help

You will need to prove it is a manufacturing fault. And that is where the time, money and hassle comes in. Have you had any quote on how much it will cost to repair?

Have you tried writing to them with a nice concise letter appealing to their better nature etc?
  • i have written them an email maybe i should write a sob letter. i thought it was the case i would have to prove it was a fault which i am not sure i could although when they look at the pram and where it is broken i would hope they would agree. thanks for youe reply....

its worth noting that your case now falls under the sale of goods act and that your case should now be entirely dealt with by the retailer you bought the pram from

the manufacturer are spot on in telling you they dont have to do anything outside of the warranty

the retailer should offer you one of three options, repair replacement of refund, whichever is more economical for them usually. this is however only if you can prove that the product was inherently faulty from manufacture.
    Back by no demand whatsoever.
