Personal dispute or not help please

hi all i posted on here before regarding ordering goods them being delivered to neighbourgh whilst i was away, neighbourgh says given package to brother brother says neighbourgh did notheres the threadhttp://forums.moneysavingexpert.com/showthread.html?t=2059301&highlight=now today i get a call from track and trace after 5 phonecalls from me chasing this up, the lady says the delivery driver has been interveiwed and says that he delivered to neighbourgh. i know this i told them this weeks ago they are now saying that as they have a signature from my neighbourgh that it is a personal dispute between me my neighbourgh and my brother problem is i had a dispute with the same company previously for leaving parcels with neighbourghs and in my electric cupboard that is outside my front door in a block of flatsi have told them over the phone, in numerous letters one sent recorded delivery and one sent special delivery and about six times on the phone please do not leave my parcel with anyone other than me i was even told last week that they would send the courier comapany an email to ensure this happens2 days later i get home to find an order of arround £70 slung in my electric cupboard and a card through the door then the next day a card through my door saying another parcel left with my neighbourgh the lady on the phone today who told me that this is now a personal dispute said that there was not even a note onmy account to say do not leave with anyone other than me but that she would put one on there now...when i asked her what i should do now taking all of the above into account she went silent untill i said well im pretty sure that when i ordered i entered into a contract with you to deliver said item to me and this has not happened and given how many times i have asked for goods not to be left with anyone other than me if i were to go to a small claims court what do you think will happen she quickly replied that she will get the driver interveiwed again and get back to me i asked how long this would take and was told 2 days am i right in what im assuming above that my contract is with them to deliver the item to me what and where should i go next pleaseany help or advice would be very appriciated many thanks

sorry all now my laptop is playing up i had this before i write it all out on paragraphs and it comes out as abovei can not remember what solved it last time i know i do not have any viruses as have just had a total restore done0

I'm sorry if you take this the wrong way, but I'm dyslexic. I couldn't read your post at all and so put it in to word. May I suggest that before posting you do the same as it only took me five minutes to make the above.
More to your point.
It's going to depend on your terms of service with the company. What you could really do with is written acknowledgement of the letters you send requesting the note on your file.
Not only that, but if the contract you have for delivery states that they deliver to the address or a 'safe place' then they are under no obligation to modify those terms (regardless of any letters you send recorded or not)
They have delivered the parcel to your address and have left it with the neighbour (you say that you're aware it was left with the neighbour and so you know that it was delivered). If all they agreed was to deliver to your address and leave in a safe place, then notwithstanding good will and common sense, that's all they're obliged to do.Almost everything will work again if you unplug it for a few minutes, including you.
