So can hardship cases still claim??

Er don't think so. Hardship cases are now in the same boat as anyone else.
If you want to have a chance of claiming you would need to use Martin's new section 5 argument (see his "Phoenix from the Flames" article). But it will probably take years to decide (again) and may not work in the end anyway.0 -
Refunds are still possible for those in exceptional circumstances, or at least they certainly are at some of the institutions involved in the recent trial.
I'd suggest to the OP that they get in contact with their provider and talk through their situation (and options) at the earliest opportunity...0 -

I am reclaiming in hardship from HSBC and they have been paying me back a measly £150 a month. Is this likely to continue?0
