urgent help with Lloyds

my Lloyds account is charging me £15.00 a day for being overdrawn (which is due to their charges!) and between £20.00 and £60.00 for each unpaid DD also due to them draining my account. I had been trying to negotiate reducing the payments on my credit cards, but the bank was refusing to pay these as well (resulting in the debt being passed to a collection agency who want payment of the whole amount) Does this count as being in hardship, and does anyone know what i can do about the collection agency!

  • To be in hardship the bank must first establish your income and expenditure.

    Basically you must write down what comes in, then what comes out. If there is a minus after this, then you are more than likely to be considered in POSSIBLE hardship. If there is a surplus, then the bank may look at a restructuring option.

    Don't ignore the charges and think that it is those alone that is causing the problem. As hard as it sounds you need to get your priorities straight - if you like to have a few pints, maybe a mcdonalds every week etc, then these have to STOP until you can really afford them. You have bank charges because you have mis-managed your account, it's as simple as that.

    Cancel your dd's and pay them in cash or with your debit card over the phone - ask BT and you gas/ele supplier to give you a payment card so YOU are in control, not CONTROLLED by a dd that can be taken electronically when you don't realise.

    Last but not least, DO NOT be bullied or pressured by a collections company, stand your ground and make a realistic offer of payment. Don't ignore it, the letters can become areal burden on your day to day way of life.

    We're all here to help, but you must help yourself first by getting in touch with the bank, go for a chat with your branch - this may help??

  • our local stag hounds are the reason i have no money. They've wiped two/thirds off of my income by stressing my stock so much they abort and the ones that are milking dry off. They've been doing it for afew years now (yelling, screaming, horn blowing,frantic dogs and of coarse LAUGHING)
    I had to reduce my income and stopped going out years ago. I have a turkey for Christmas, but thats it. No presents, parties or alchohol, if i did start drinking i doubt i'd stop.
    I've cancelled my DD's today and i'm now putting post-its everywhere to remind me to pay them (thats why they were on DD's), i work 15 hours a day/7 days a week (i can't afford any help) so i rarely know what day it is, let alone the date!
    I take it the hardship thing no longer counts, i'm trying for a loan and i'm stripping my house and putting it on ebay.I'm hoping i can reclaim some PPI's as well.

  • No, they were just restricted, and the law has so many loopholes that alot of them have just carried on the same. The police havn't the time to help unless they actually hurt you. Write to your M.P. 'cause the Conservatives are planning on bringing it back!
    We're getting of the subject, i'm going to see a specialist at the C.A.B. next week. Sounds hopefull, i suppose he's used to it.
  • When you've tried everything on this wonderfull site and everything is still pear shaped and pannick is setting in, go to the C.A.B. for advice. They've seen it all before and they know what to do, or will put you in contact with someone else, depending on your circumstances.

    TSB are very little help and very unprofessional!! I have about 600 quid in charges on my account and told them in July that I couldnt afford it even doing an income and expenses which clearly told them what position I was in. I basically told them I could afford 100 quid to pay them and clear the balance and that was refused - even though they accepted a reduced payment in January for my loan.

    My situation is that my father died 3 years ago and I want to help my family with bills which need to be paid but again never seem to care and nor do they justify why you arent in finanical difficulties - thats why they get a lot of complaints about this to the ombudsmen and they are obsolutely pig ignorant on the phone.

    I explain that I had a situation about my dad and that he died 3 years ago which would make it 2006 and they recorded that on the system as 2007. They also say that I broke pay plans 3 times with the last in July this year - that was an error at there end that it was set up and they acknowledged that. I have sent them a final letter and will take them for data protection as I find it totally unacceptable. Hopefully I will get their answer in the next week as I sent the letter on Monday last week and got their confirmation on wednesday that the complaint is receiving the attention it deserves - with TSB I dont know what that means.
