  • As has been said before, it is Personal Protective Equipment. Emphasis on PERSONAL. Your employer has a duty of care to provide you with it if it is neccesary for your job. No if or buts. If he refuses he is breaking the law.

    SOrry but you are wrong.

    There IS, as the OP stated, a face mask for him to use.
    How some of you can have that kind of opinion without even knowing what he is exposed to is ridiculous.

    It isn't very hygenic, but the boss is not under any legal obligation to provide one each.

    A NEBOSH qualification and guidance from the HSE say otherwise. The title itself speaks for itself though. It is PPE, PERSONAL PROTECTIVE EQUIPMENT not SPE, SHARED PROTECTIVE EQUIPMENT.

    Granted it is a last resort and should only be used where all other risks have been removed or controls put in place, as part of a suitable risk assessment.
    Personal Protective Equipment at Work Regulations 1992. Regulation 4 states:
    Every employer shall ensure that suitable personal protective equipment is provided to his employees who may be exposed to a risk to their health or safety while at work except where and to the extent that such risk has been adequately controlled by other means which are equally or more effective.
    Section 9 of the Health and Safety at Work etc. Act 1974 states: "No employer shall levy or permit to be levied on any employee of his any charge in respect of anything done or provided in pursuance of any specific requirement of the relevant statutory provisions". Section 9 applies to these Regulations because they impose a 'specific requirement' - i.e. to provide PPE.

    Ive worked in construction for 12 years.

    PPE is signed out for one person , not two.
    They are well within their right to demand their own.

    I am NEBOSH qualified and you are wrong. If you had any idea wat you are talking about, you wouldn't need to quote (incorrectly) from a website.

    So it seems I am wrong, the above posters are wrong, NEBOSH is wrong and the HSE is wrong.



    How would the user know if there was damage caused by a previous user?

    How would the user know if there was a transmittable disease being carried in the mask?

    How many users are permissable to use the mask; 10,50,100,1000?

    Why isn't the overall risk increased by sharing the same mask?

    With so many users who is responsible for the maintenance and storage of the mask?

    Etc, etc, etc.

    OK, so you are saying shared face masks are OK. There is a serious divergence here between what Joe Public [me] thinks acceptable and what you are saying is OK - and for once, Joe Public is taking the hard line on H&S.

    Now, either NEBOSH is getting it wrong or you are. Shared face masks is a filthy idea.
