Question about the Shorthold Assured Tenancy Agreement

Just wondering if anybody can help me ? We have recently moved back to UK from Aus and signed a shorthold assured tenancy agreement for 12 months. It says on there we must give 1 month's notice to leave.

Now, my question is, we've paid 6 month's upfront to the rental agency and now we've only been here for 3 months and we want to give 1 month's notice to leave as we've decided to return back to Aus. Can we get our other 2 months rental that we've already paid upfront refunded back ??? or not.

Do we have to pay the full 12 months rental??

Be grateful for your advice.

    You need to check your contract carefully BUT I'm sure the 1 month notice will be after the initial 12 months is up - not during it. Oherwise a 12 month contract is worthless.

    You will have to pay the LL the costs of getting a new tenant and any months in the 12 that a new tenant cannot be found once you leave.

    Unless the notice clause is in the form of a Break Clause you are committed for the full 12 months. However, if that's the case, you can ask the LL to re-advertise the property, to find a replacement tenant, with you meeting the costs involved.

    Can you post up what it says?
  • Are you in England or Scotland?? In England tenancies are usually called ASTs, in Scotland SATs..(Short Assured Tenancy).

    Assuming tenancy normally the Landlord would have to agree to your getting the last 2 months back..
