Creditor saying their £12 charge is fair - what shall I do next?

Hello again, how are you all!?

I recently sent the template letter from this site to the Co-op bank to reclaim my CREDIT CARD charges. They have written back saying that the charges have all been £12 & that is the amount that the OFT says is fair. So therefore - NO, you cant have 'em back.

Is that final? Is what they're saying correct? If the OFT says thats a fair amount then I guess there's not a lot I can say is there?

    I am pretty sure the OFT has not yet made any final statement about what amount is fair. They might have mentioned £12 at some point but it will only have been in a provisional way. The co-op is bluffing.

    Ha ha - they say in the letter that 'these charges are within the GUIDELINES set out by the OFT'. They also say that they are in line with the terms of the contract & that I must ensure that comply with the terms of that contract.

    Hmmmm...what shall I say?
  • The OFT said this ( I seem to be quoting this ALL NIGHT LONG on the bank charges forums)
    "Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims."

    For reference, OFT 842. Point 1.14

  • Im not sure if its me or other posters who have got it wrong but credit card charges are already sorted and are set at £12 which is what you have been told

    What co-op say is correct.
  • yep. sorry OP but as far as I know the limit has been set at £12 per charge for credit card charges. anything over this you can claim back

  • Hmmmmm, so basically, I'm wasting my time writing to them any further?

    Seems so strange when I've had 2 other creditors recently give me a full refund of my charges which were also only at £12.

    Is there anything I can do?

    I did my credit card charges through Access Money in Manchester. I had them all returned within 4 weeks less their charge of approximately 25%.

    Their initial response is standard. If you stand firm and insist on all charges being refunded they will fold.

    No you're not wasting your time. Natwest has already given you great help, below.
