Redundancy Letter Sent 3 Months Ago

Hi.

I was sent along with the rest of my department a letter 3+ months ago stating there will be 3 redundancies. The letter at the end stated these 3 people will receive a letter in 3 days indicating it was them. Still no news and we all assume it's still on.

Where do I stand now if they make me redundant, will they have to go through another process, send another letter. Are they in breach of any laws they should be following.

    It would be interesting to know:

    1) How many people are in the department?

    2) What roles are going to be made redundant and the numbers performing those roles not just within that department - but throughout the site AND other sites close to the 'affected' workplace?

    3) To enable the three people to be made redundant, a consultation period must take place. A scored selection matrix using objective and to a lesser extent, subjective criteria should also be utilised to determine who will be dismissed. Is this process now ongoing and have affected people been told the selection criteria, the method of scoring and who is going to apply the scoring? - all very important.

    4) Has there been any effort by the company to mitigate the likelyhood of compulsory redundancies - ie asking for volunteers/early retirement etc?

    Incidentally, if all the people within that department perform the same role, in theory, ALL members of that department could be informed they are 'at risk' of redundancy, however, (although a risky strategy) a company can make a provisional selection against their chosen criteria, then put only the provisionally selected employees at risk.

    I wonder if the letter that was sent was in fact notification that all of the department were at risk and also included (as likely) the reason for redundancy.

    From the information posted, it would seem no consultation process has commenced, and I wonder if business has picked up or (particularly if the work is affected by seasonal factors) the redundancy process will now begin in January after a potentially busy Christmas period.

    Rather than ask on this forum, are there no union or employee reps who can ask the company directly on what the hell is going on? If the question has been asked, what is their reasoning or excuse for their procrastination?

    It is not in the company's best interest to have ALL of a department under the threat of redundancy just before Christmas (or at any time for that matter) and having the torment prolonged only compounds the anguish.

    From experience, the rumours will start, telling tales to management in the hope of saviour, backstabbing, bad feeling etc. etc. - hardly conducive for an efficient and effective workplace. It is an awful situation and I sympathise.

    I would definately approach management/HR and find out what is going on - they owe you that at least.
  • It's an IT department

    10 or 12 members have recieved a letter (the full dept)
    No consultation period as yet
    No compulsories.
    I think the initial letter or at least we were verbally told that there will be various criterias used to determine the redundancies.

    There have been some redundancies in other areas over the last few months, mainly a few months ago.
