    Sorry for not getting back to you before now - I had a bit of a 'wobble', but feeling OK now.

    I don't see how your Trustee could come after you for any fees if he was the one who resigned :confused:. If he didn't say at the time. 'Oh,by the way, you owe me money' then you'd appear to have a good case for challenging him if he did come back and ask for money now.

    However, if he did, and you didn't want to challenge him, then it would be a debt incurred before your DAS was set up. That would mean that your money adviser could apply for a 'variation' to have it included in your DAS. It would need a decision by the DAS Administrator, but I'm sure your money adviser would make a good case for you.

    I have to say that I think it's very unlikely that the situation will come up.

    Less positive on the Edinburgh Gazette front though, I'm afraid :(. Given that you did sign a Trust Deed, the Gazette isn't wrong - so you couldn't ask for it to be amended. (It just records Trust Deeds which have been signed - it doesn't go into whether they become protected or not).

    I'm not sure about your credit file, tbh. You did sign the Trust Deed, but you're no longer in it - so you might want to try to have that reflected on your file. However, although DAS will protect you from a lot of things, it will still affect your credit rating. So, you'd have to consider whether or not it's worth the effort, for you, to lock horns with the credit reference agencies over this one.

    Thanks for your reply, glad you are on the mend and cant thank you enough for everything.

    I think as the Trust Deed is recorded on my credit file for 3 years its probably not worth chasing as we are already 1 year down the line.

    On a positive note everything is sorted now and we can afford our payment to DAS each month and hopefully will be able to put a lump sum into it next year which will bring the length of the DAS down.

    I am relieved and for the 1st time in ages i slept all night last night.
