Couple of re-claim questions

I have just sent my Step 1 letter off to First Direct to find out how much my charges are over the last few years. However, I notice they are still charging £25 for going over your overdraft, which is more than the £12 (I think) that's been suggested as sensible.
Is it a case of once you put in the claim you need to make sure you don't incur any charges again? Or can these also be claimed back? (not going overdrawn at mo so shouldn't be a problem!).
Secondly, can you only claim back for the last 7 years?
I used to be with Barclays when I was younger, about 15 (oops) years ago and I got some horrendous charges, as you do when you're young and naive and can't get your finances in order.
Is there any hope for this long ago or should it just be left?

The £12 thing is for credit cards so not relevant to bank charges claims. Any charges incurred during the stay period or period of the claim can be reclaimed.
Currently only charges going back to July 2001 have to be considered. Furthermore, how old were you when you first incurred charges from Barclays?
Wednesday may be a good indication whether the claim should go forward or not but even if it doesn't the age question re Barclays is not dependent on that decision.0 -
Ah right, ok, how do banks work out what they might offer you regarding charges on general overdrafts going over the agreed amount then?

As you were over 18 my argument on the barclays account wouldn't apply unfortunately.0 -
I wouldn't be classed as being in financial hardship, and am happy to wait for the outcome like most other people.

You are asking for 100% of the claim and ultimately if Wednesday's decision is that the banks' appeal has failed then a court will decide that question ultimately.I wouldn't be classed as being in financial hardship, and am happy to wait for the outcome like most other people.

Ok, sorry, one more question...
So those that have said they incurred x amount of charges and got x amount offered, are these the people who have claimed hardship?
So for the rest of us, we can only request the amount of the charges and await wednesday's decision?

Wednesday's decision has huge repercussions on reclaiming. If the banks' win then forget about refunds. If the Banks' lose then its game on for everyone and potentially reclaiming going a lot further than July 2001. It is VERY complicated at the moment. I am not sure if I will actually be on the forum on Wednesday because I need to work out what will have happened and what advice to give.(So keep an eye on MSE on Wednesday after about 10ish.
At the moment, refunds are based on alleviating financial hardship so may not be 100% of the charges. Everyone else's claim is on hold for the time being.0 -
