rights to cancel an order if there has been/will be an undue delay in supply??

We ordered a French Horn from a "reputable" maker via the schools purchase scheme- so I am aware the contract is actually between school and supplier but I need some info about where I stand.

Order placed the week before half term, so 5 weeks ago.

Initially P*sing about along the "we haven't revieved it....posts dodgy etc" moving on to aknowledging reciept of order last week BUT espimated supply date of end January!!

THis is a professional model french horn from a prodessional supplier not a "student " model so it costs plenty- you'd think they'd be keen for orders- it is pretty much the "flagship model" if that's the right term.

What right to I/the school have to cancel the order and GET A REFUND in full because of unacceptable delay?

I have found a 3rd party retailer who may have stock- awaiting reply tomorrow. I'd like to cancel and get it from them if they have one they can just dispatch straight away really.

    As this is a business to business transaction (school to supplier) it comes down to what the terms and conditions of purchase state. I suspect that they will say that delivery times are estimates etc.

    I would ask the school to get a copy of the t's and c's and contact the supplier to see if they are willing to cancel.

    You need to specify that 'time is of the essence' ...then you've got a chance of cancelling.
