The main account holder who makes the booking with the main credit card i imagin,e and whoever he has included in the trip if it has been paid for with the card.

On reflection, i dont think its a case of who is covered anyway, its the costs that are covered.

If the trip has been made by the secondary holder with the 2nd card then i dont think you can claim but i am happy to be corrected.
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • I would disagree with you - if the credit card company have let you have a 2nd card holder and the main card holder is responsible for all debts run up on the card (or the account if you like if there is more than 1 card in issue)then the same right must apply to all cards.

I would think any claim would have to be made by the main cardholder.
When I used to have my wife named as a secondary cardholder there was no seperate annotations as to who spent what.

No. Purchases by additional cardholders are not covered by Section 75 (CCA) protection. There is a Financial Ombudsman case study about this very issue - see case 62/02 here: http://www.financial-ombudsman.org.uk/publications/ombudsman-news/62/62-consumer-credit.htm

    I stand corrected.

    I stand corrected.
In the case study referenced above the additional cardholder purchased something in her sole name for her sole benefit.

If the additional cardholder makes a purchase for the joint benefit of both themselves and the primary cardholder, or for the sole benefit of the primary cardholder (ie a present), then I'm fairly certain I've seen (probably on the FOS site) that the purchase is indeed covered under section 75...being as the main cardholder has a beneficial interest/enjoyment.

I too may have to stand corrected though!

As far as I am aware the law gives protection only in specific circumstances which do not apply to purchases made by additional card holders. Where the purchase is made using an "additional card" it must (by the card T&C) have been purchased by the additional card holder.

I can't see anything in the CCA that gives protection based on who the goods were purchased for - only the link between lender, vendor and purchaser. Using an additional card means the lender does not have a direct relationship with the purchaser, and section 75 doesn't apply.
