My parents have been going through something similar, let me recap whats been happening so far-
My Dad is going bankrupt (my Mum is not).
My Mum gets Pension Credit and Dad gets Carers Allowance paid into joint account (lloyds Tsb).
My Dad went to the cash machine machine a few weeks ago to get some money to do food shopping (they get paid every Monday) and found that Lloyds had taken all there benefits for bank charges, fees etc. Thankfully I was able to help them out as they would not have been able to get any food shopping that week. What we did was open a basic account at Barclays in my mums name and arrange for there benefits to be paid into the new account, two weeks on and all the benefits have been successfully paid into the new account (will be from this Monday as online banking shows the money as gone in on Yesterday).
My Dad got a bank statement from Lloyds last week saying that they were going to to take £157 in more charges, fees tec at the end of the month. To combat this we got a form from Lloyds to get Mums name removed from the Current account and the empty savings account, Yesterday my Dad said that they recieved a letter from Lloyds saying that my Mums name has been removed from the account.
So to cut a long story short Lloyds can go and sc$%w themeselves , when they try and take they £157 they will be no money in the account accept thier overdraft (not touched), so they will be taking thier own money. The account will be put in the pot with the rest when Dad goes bankrupt.0 -

I got a letter yesterday from Lloyds saying that as they had paid some items that I asked them to, (those items being charges which I did not ask them to take at all!!!) I had gone over my agreed overdraft, and so they will be charging me!!
Tonight we will be ringing the co-op to get our nice new account set up and transferring enough into it to cover the dd's which I will then sort out, and then Lloyds can take as many charges as they like!
What annoys me with this is that they are making me go od because of a ridiculous £69 charge for when I went over by £3, and then it will just get worse as there will be charges on my charges and so on! This is one debt that I do not feel bad about going BR on at all!0 -

very well put.......and those ever-so-upright folks who think BR's are financial weaklings who should be punished for their failures, should take a careful look at the real reasons why so many are forced into debt?

in view of the bank's actions [and lack of concern for their customers] I'd have used the ovrdraught faciltity before the bank does...reclaim some of that benefit money they relieved your Dad of..?

That's it exactly Alastair, I can't get out of the overdraft as they keep adding on loads of charges, it's a vicious circle. The same goes for some of our cards, one payment missed or late and on goes a £12 charge, and as for the high interest rates!!
Our Egg card has gone up from around 8% to 26.9% in a couple of months, so our minimum repayment more than doubled!!
I am aware that some/a lot of it is our fault too, we shouldn't have used cards for some things, but at the time we took a lot of these we were both earning good money, now we are not, combine that with high charges and high interest rates and it doesn't bode well does it.0 -
As Martin...of MSE...says..the credit card companies truly HATE with a vengeance, anybody who, year-on-year...clears what they owe by the due date.

Banks HATE with a vengeance, anybody who does not go overdrawn, and who incur no charges...because they make no profits.
Banks, CC's, loan sharks--sorry, companies....all rely on the punter actually making the mistakes...because the punter's mistake means profit for the company.
and they all activley encourage customers to get ensnared, and make those mistakes.
The main reason why BR's are disliked so much [even to the point of subsequently being the victims of petulance]...is that BR stops the profit flow.
Morals?
why, as we have seen on here, they even try to diddle their own kind, by 'selling-on' debts to DCA's which are in fact of zero worth to the DCA....

Well I think this whole thread has made me realise that what we are doing isn't criminal. I understand we took the loans on etc and are now unable to pay them back, which is our own fault (we decided to reproduce afterall) but when I asked them for help or some sort of arrangement for a short period whilst we got sorted they aren't interested. Its terrible that they are doing this (especially to your parents Jaks) and allowed to get away with it.
I can't bring myself to make the account maxed to the overdraft at the moment but that may change depending on what Natwest say tomorrow.
My husband did say to me earlier "well imagine how you would feel if you lent someone £25,000 and they just turned around and said they weren't going to pay it back, you would be pretty annoyed" but I explained these banks will barely even notice due to the amount of money they are taking in charges from people on a daily basis. Also I dread to think how much money they have taken in interest and "Fees" for our "gold" account over the years, I'm sure we owe them hardly anything of the original amount. Also the only benefit I have ever tried using on the amazing gold account is the mobile insurance. My husbands phone stopped working and I tried claiming, but because I didn't inform them within 48 hours they wouldn't accept the claim!
Anyway sorry to waffle on but morally myself and my husband feel as though we are in the wrong for taking this course of action but the bank are helping me feel a lot better by acting in this way.
Any idea what the bank may consider a "Valid reason" for missing this months payment? I will push to get the money back but doubt this will happen now
They were perfectly happy to let the other debt's direct debits get cancelled online just not thiers... amazing.
Also if I ask them to change the date on the payments will this cause a problem for the BR? as it will be obvious that I have changed the date to take effect after the date of going BR...
