Should I go for an IVA and shold I go with Balir Ensbury? I have doubts about them.

  • Just wanted to update everyone about the current situation. Especially for those who have recently posted with concerns with Baines & Ernst/Blair Endensbury!

    Cancelled my agreement with them last monday as mentioned before and nothing was signed with them. Still waiting for my call from CCCS on Tuesday coming.

    Friday BE took a payment of £180 out of my account which should have been cancelled. Spoke to them on Friday, to which I seemed and inconvenience, when it was their fault I had my doubts and cancelled. And very sharply and firmly he said they would refund it. Just managed to ask him what about the £35 charge they are no going to slap on me for going over my overdraft limit and if it wasn't back in the account by Friday evening I would be charged an additional £28, to which he said we'll send a cheque!!! Arrrggghhhh. Because of that they have taken all my spare cash and created charges...And I'm now resorting to the CC to by Petrol and basic groceries like Bread and milk!!!

    You should be able to force your bank to refund the money on the grounds that it was an unauthorised DD and you're not paying it... furthermore, the payment going back in to you account from BE would prove that!

    It's certainly worth the effort of speaking to your bank!

  • Update-Spoke to CCCS this morning. Very helpful lady and was on the phone well over an hour.

    But I'm even more confused! She had originally advised BR-felt that was quite drastic. Currently owe £113K on interest only mortgage-House currently worth £107k-£118K according to Zoolo, so worried that although in 12 months we will be debt free and negative equity, we may have gained equity in the house in 3 years. I really don't want to sell up and move???
    She had also advised that i did it in for me only-as my partner's only joint in the mortgage and the loan-But he will be left paying the loan-which is fine-but rest of the debt minus the loan is £5/6k, seems a bit drastic going bankrupt for that amount then possibly lose equity??

    She changed the figures around a bit and mentioned DMP-which would take 10 years, and IVA. Both payments will be what I'm pay towards debt now and we still can't manage. With the IVA we could still lose equity in the house in 5 years?

    I'm still going to change my bank account-I was thinking of coming to an arrangement with halifax, at least if they stop the interest on the overdraft and CC then i can start paying things off, is this possible?

    Update on problems with BE, after several calls back and forth to Halifax and BE, it's been a nightmare, still waiting for the amount to be refunded. BE are saying it's on it's way, Halifax can't see it yet. Sent a letter to BE about charges, DD's and Cheques are due to clear, so desperately hoping the money comes back in in time.

    Thank you all gain for listening to me ranting on and endles questions. I appreciate all the help and advice.

    Sounds like you do have a number of options available - I wonder if you might feel like posting your statement of affairs on the debt free wannabe board. Over there you will get lots of fresh eyes looking at your figures and looking for solutions (of course they are not professionals like those you have already spoken to) but do have real life experience of dealing with debts.

    I guess another thing to think about when deciding on which option to take (and which is not always asked by professionals) is what your plans/expectations are over the next few years. Do you feel you are likely to increase either of your incomes significantly? how safe do you feel your jobs are? are you likely to want children which will reduce you down to one salary for a while? Whilst none of these are easily answered questions they are things for you and your partner to think about when making your choice.

    Good luck and also with getting your money back from BE.

  • I have been one year in an iva with them and i would noot recommend to go with them at the beginning they are very happy to take your money but when your iva is settle they did not help at all avoid them go to your local cab and ask them for advise but do not go with them
