Sorry to keep asking questions, but I wonder if I could get some help on this one please?
I plan to go BR the end of next week, but my wife cannot go yet due to the costs 9I have huge IR bill and need to go now). However we have just had a summons for non payment of Council Tax for £1178 inc costs, for 8th December.
Now the thing is that we had a payment plan in place to pay the arrears, which my wife paid from her account. I find out now that she missed last months payment because or our daughters birthday. I must admit that I got pretty angry as I know you cannot afford to mess with Council Tax!
Anyway, as the Council Tax is in both names, my going BR will not help - I do not know what to do, please can anyone give us some advice?
Many thanks

Having sat down and spoken to my wife, maybe we should forgo everything this month and both go BR and that would clear everything!?0

Can you claim the fee remission at all?
Court fee remission and forms.- HMCS - Court fees do you have to pay them? (And guidance on completing the fee remission form). (pdf)
- HMCS - Form EX160 - Application for a fee remission (pdf)

            Hi,
You could as you say both go BR which would wipe the entire debt, that would depend upon how much debt your wife has.
Otherwise, you go BR, and your wife continues to make the payment arrangement she had ( nothing much you can do about liability order costs coming up). This is an opertunity to get back to an instalment arrangement before the council send it to the bailiffs.

How long before you can save for your wife to go bankrupt?
I found that I didn't hear from the baliffs till at least 1 mth after the court date - march-ish (which i was too scared to go to, silly really) and then I got a letter asking me to pay in full - which I couldn't, and was told by the office staff to wait for their visit which wasn't until May.
So that should give you enough time to save.
If it does get that far before you can both go bankrupt for goodness sake don't let them in even if they say they are busting for the loo!!
hope this makes sense and helps, i'm trying to eat and type at the same time (rather unsuccessfully ) 0 ) 0

Thanks all, we think it best if we both go and forget Xmas.
My wife owes about £25K (joint debts, but would fall to her)0

if that's what you decide, good luck.
Xmas doesn't have to cost, as long as you're together that's what counts!

Being debt free would be a great Christmas present!

Christmas means nothing to me, debt free far more important!
Just feel bad for my 12 year old we really will not be able to get him much of anything. Although he will have plenty more Xmas' and perhaps a valuable lesson to learn, that people are more important than stuff.0

hmm tricky one with a 12 year old!
i went br this week, feel strange, mood up n down but i do feel a certain relief. i would say to anyone if you're going to do it, do it sooner rather than later. i wish i had done it long ago but takes a while to accept!
 wishing you all the best0

if you decide to do a joint BR.....decide also what paymetn you can 'miss' that will be included in the BR.....to help fund the costs, and maybe get a reasonable prezzy for no1 son/daughter?
[I find out what is REALLY wanted......get that [if I can afford it], and quite a few one pound wonders......if anything is left, get something nice for the lady of the house? Time for paper chains and homebrew?]No, I don't think all other drivers are idiots......but some are determined to change my mind.......0
