We already have a legal system similar to the American system eg no win no fee, the only real differences being we don't really have the punative damages they do and the settlements are calculated by a judge rather than a jury (Except in NI)0 -
Thanks everyone for your advice and comments - I contacted my insurance company who advised me they were dealing with her solicitors directly - they also told me that the papers that came to me should have been sent directly to them instead of to me (although the person I spoke to said that sometimes they do this in hope that the person will decide to settle with them directly out of court for whatever personal reasons). I have also since received a letter from my solicitors advising me that they have arranged a solicitor to represent me. I did know that the case was ongoing and they were still in contact with her solicitors, but I didn't realise in personal injury cases you have to take action within three years, which is why they sent out the letters.

Also I'd just like to point out I don't have anything against solicitors, or the fact that they might get paid a lot (not sure where you got that idea from, LegalBlonde?). I know that dealing with the law is a skilled profession (as I learned firsthand from how little I know about how to deal with those papers coming through the post for me). And my comment about no win no fee companies was merely based on one such company trying to get me to sue a former employer for tripping over and hurting myself at work (totally my own fault).
