  • Even if you could prove negligence, and the other factors required for damages (that the accident was forseeable etc), damages rarely compensate for being upset. It is costs and losses that the court is interested in. Not sure about the holiday but for example if there were medical expenses or lost wages, not applicable to the NHS or children.

    Beyond that even if the pub was negligent they could be held responsible without you receiving any money if the judge can find no need for compensation in terms of economic loss.
  • Accidents happen. Move on and stop dwelling. The point of suing is to get money, if you don't want money (like you said) don't sue.

    Maybe your son shouldn't have been playing on this climbing frame.

    Maybe you should sue yourself for leaving a child with learning difficulties unsupervised.
  • Kids fall over and hurt themselves sometimes...it doesn't mean someone else was to blame.

    Just a thought Proc, but maybe the OP was coming on here asking for advice as they were not knowledgable on consumer rights?

    So rather than giving a rude an abrupt answer, a helpful and constructive response would be better (as given by other people).

    To the people who seem to be naive about autism, the best thing to do to help them is not to wrap them up in cotton wool and not let them do anything unsupervised, but allow them to explore and find out stuff themselves.

    Although their are alot of venomous posts by the typical "People must be punished for daring to ask a question" Brigade, the actual content is correct.

    I am failing to see any negligence on the part of the restaurant. Was any of the equipment faulty, or was it just an accident?

    To put it into perspective, I twisted my ankle on my stairs. I am not aware that there was anything wrong with the stairs. Should I be suing myself?
    Gone ... or have I?

    as others have said it was an accident, perhaps YOU are at fault for not keeping a closer eye on your son,

    Because the OP mentioned other people had told her she should sue, she just wasn't sure exactly what they were telling her to sue for.

    so she WAS minded to sue,but did not know what to sue for? is that what you are saying??

    If so then she WAS indeed hoping for financial gain although not sure how to word it/approach it

    Sadly it's people like this that affect thousands of people lives by increasing the ammount of 'health and safety' legislation/guidelines
