  • does anyone know what a notice of distress is and what powers it give the bailiffs?

    Effectively its a notice of their intent to remove goods. If they have correctly levied your goods (which it sounds like they haven't as the car wasn't there) then it means they would return to remove the item listed - in your case your car.
    And whilst you know the car was not near the property at the time it might be difficult to prove. I think you probably need to keep the car away from the house as suggested before else they might easily turn up and remove it.

  • If the car is 'needed' not 'desired' to get to work they can't levy it.

    I also believe the car has to be at or near the premise (your house) to place the levy.

    And finally i think bailiff charges can't exceed £42.50 for a first visit, + levy charge so £300 for fees is too much. I would get Herbie21 to give you some advice.

  • the car was with me 4 miles away at work. there was no letter when i left for work, my eldest daughter was in when it was pushed through and she said it was about 8amish....i left for work before 7am. i need the car to commute to work and back as there is no bus at that time in the morning. they have also charged over £100 for turning up with the van to remove items which they have not done. i rang the council to try and get the debt taken back so i can pay them in installments, i was in a queing system for 27 mins, the woman finally answered and took my details and said she could send me out a stament of means, i told her about the bailiffs and asked could they call them off...at that point my call was disconnected and when i rang back the queue was even longer so gonna phone again this morning when they open at 9......so so worried and dont know what to do

  • You probably haven't setup your forum account to save sent messages, so as long as it said message sent she will have got it, it just isn't saved in your outbox to save space.

    When sending private messages the forum can make a copy of the message in your Sent Items folder.

  • I work as a local tax officer so hope I can help.

    First of all call the council, the bailiffs are instructed by them, and although they may not call the debt back they should still be able to help.

    If you are appealing for a backdate ask if you can have the bailiff put on hold while this is going on, council tax and benefits do work closely together and they should be able to get a time frame.

    You said you are working but are now in receipt of full council tax benefit, this implies to me you are in receipt of a benefit? JSA, ESA..? If they do not want to place the bailiff on hold, especially if a backdate seems unlikely they should be able to instruct the bailiff to accept a payment arrangement over a longer period of time than firstly instructed, as they have sent out an income and expenditure it looks like they are progressing it, but try and request the bailiff is put on hold while being looked into.

    This is advice is really based on my own place of work, I do not know how other councils deal with all situations.

    i work but only part time and my last months pay was £400, i recieve child and working tax and child benefit for 3 kids. i rang the council yesterday but as i explained in my earlier post i got cut off, i rang again this morning abd was told i need to speak to the recovery department who are shut till monday. i owe about £3000 in total to council tax. i do want to sort out a payment plan but in the past when i have tried to do this they always demand more than i can afford
  • just to update all who replied, i have spoke to the council recoveries department today and they are taking the debt back from the bailiffs and my offer of £10 a week has been accepted by them. thanks for all who responded to nthis thread.x.x.
