50-50 fault accident- responsibility for paying for damage?
I had a wing mirror knock with an oncoming car earlier on a narrow road. I should have been going a bit more slowly through the gap, she shouldn't have been so far over onto my side of the road, so pretty much a 50-50 fault accident. My mirror doesn't seem to be damaged, on hers just the glass broke. I can get the glass from GSF for under a fiver (although £9.40 with delivery:roll: ), and for the sake of less than a tenner I'm inclined to just pay up for the sake of an easy life. Still, I'd like to know the legal position in case she starts playing silly ******s (e.g. it being a non-Peugeot part etc.)- how's the damage broken down in a 50-50 fault accident? Am I resposible for the damage to her car- and her for mine, had it been damaged? Or am I responsible for 50% of the cost of repair?
Quick replies appreciated- I want to ring her tonight to make sure she doesn't do something daft like pay £30 quid at a Peugeot garage and expect me to pay it....

Legally you must stop and exchange names and addressess.If the accident is as you say I would pay for the damage to your vehicle only. In the absence of independant witnessess the insurance would do the same. I understand insurance companies do not consider passengers in either vehicle as independant.:j0

First, thanks for the quick replies, and sorry not to come back sooner- my broadband is very flaky at the moment and only works for minutes at a time. We did exchange names and phone numbers, would have given my address if asked. Is it legally the case that in a 50-50 you pay for the damage to your own car? For some reason I had the idea that you pay for the damage to the other person's vehicle. There were no independent witnesses (at least none who made themselves known to us) and no way of proving that the accident wasn't a 50-50; there's no question in my mind that she wasn't well over on my side of the road, I would have braked if meeting her in the middle of the road. Should have braked anyway of course :rolleyes:.0
